By purchasing goods and/or services from picturecity.ph, by browsing or otherwise accessing it in any manner, you agree to be bound by its guidelines, notices, operating rules, and policies, as well as any amendments that we may introduce to these, that are published in this document and elsewhere on this website. Acceptance of these terms creates a binding contract between you and Picture City International whereby you agree to use this platform only in accordance with these terms. Kindly take further notice that we may amend these guidelines, notices, operating rules, and policies at any time. These changes take immediate effect upon publication on this platform, unless otherwise specified.

If you do not agree to any of these terms, or of any other guidelines, notices, operating rules, and policies governing the access and/or use of picturecity.ph that are published elsewhere on it, do not use this website

picturecity.ph is intended for use by adults. You must be at least 18 years old to use it, or otherwise be of legal age in the jurisdiction where you access this website. Apart from this age requirement, you may create a picturecity.ph account if you also submit certain requested information to us. As a customer, you must provide us with true, accurate, and complete information about yourself, and must keep that information updated so it is current and accurate. You are responsible for preserving the confidentiality of your account and password, for restricting access to your account, and for all activities that occur under your account or password. You will immediately notify us of any actual or suspected unauthorized use of your account.

All orders are subject to acceptance by picturecity.ph, that is, its eventual fulfillment, dispatch, and completion shall be governed by the following regulations.

You may place an order from picturecity.ph by selecting the goods and/or services and the quantity desired, choosing the colors and sizes as appropriate, or by submitting certain image data for printing, choosing the material, sizes, and quantities as appropriate; and in general by completing the order form on the website and clicking on the “Submit Order” button. We will not commence processing of your order if it is not submitted to us in the manner.

In order to purchase goods and/or services from picturecity.ph, you will be required to provide your personal information. In particular, you must supply your real name, primary and alternate phone numbers, e-mail address, delivery and/or billing addresses, and such other information as requested. You will also be required to choose the modes of payment available on the website, and to provide the credentials as appropriate. By doing so, you represent and warrant that you are indeed the individual described by the particulars you submitted, that you are of legal age to enter into contract, that the payment details you provide on ordering are both valid and correct, that you are the indeed the person referred to in the billing information provided, and that you are authorized to use these financial credentials to settle your transactions with us.

By making an offer to purchase goods and/or services from picturecity.ph, you authorize us to to authenticate your identity, to validate your payment credentials, to obtain an initial authorization, and to seek approval for individual purchase transactions. Furthermore, you agree that we may use the information provided by you in order to conduct appropriate anti-fraud checks. You also agree that may disclose this information to a payment processor, credit reference, and/or fraud prevention agency, which may keep a record of the same. On the basis of the responses we receive, and in any event at its sole discretion, Picture City may either proceed to fulfill your order, contact you to verify certain details about the information you provided to us, or to decline and cancel the transaction altogether.

Once you place an order for goods and/or services with picturecity.ph, we will send an email confirming receipt of the same. At this point in time, your order is not yet deemed accepted by us. Your order shall be recognized as such only when we send you a second email confirming dispatch of the merchandise.

All goods and/or services sold by picturecity.ph is shipped to you at your own risk, that is, any damage or loss to the merchandise you ordered shall be your for your own account and responsibility the moment it is dispatched from our premises.

All prices displayed on picturecity.ph are in Philippine pesos (PHP) and are inclusive of the value-added tax (VAT) as required by Philippine law. If the principal currency of the payment method you select is not denominated in PHP, the charge that may appear on your statement of account will be calculated in accordance with the currency exchange rules of the financial institution that issued your payment credentials.

Prices and availability of goods and/or services on picturecity.ph may change from time to time without notice.

While picturecity.ph endeavors to provide an accurate description, in words and images, of the goods and/or services it sells, it does not warrant that it is accurate or free from error. picturecity.ph may, at its sole discretion, refuse to process and/or accept a transaction for any reason, refuse service to any one, or cancel a transaction already in progress, at any time. We will not be liable to you or any third party by reason of our withdrawing any merchandise from the website whether or not that merchandise has been sold; removing, screening, or editing any materials or content on this platform; refusing to process a transaction or unwinding or suspending any transaction after processing has begun. If funds have already been remitted to picturecity.ph prior to its refusal to proceed with transaction, or the cancellation thereof, you agree that your sole recourse against it is the refund of such monies. Furthermore, you agree to waive the right to pursue any other remedies against it for such a refusal or cancellation.

For photo print orders submitted through picturecity.ph, the act of uploading your image files signifies your consent to the use of your likeness. In addition, you represent and warrant to Picture City and picturcity.ph that you own the intellectual property rights to the content in the image data to be printed, or are authorized by owner thereof, in writing or otherwise, to print the same, or that the content belongs in the public domain. Furthermore, you represent and warrant that that your content does not and will not infringe, misappropriate, use, or disclose without authorization or otherwise violate any personal, copyright, trademark, trade secret right, or other intellectual property or other proprietary right of any third-party.

You also represent and warrant to Picture City and picturecity.ph that you have obtained the consent, in writing or otherwise, of any identifiable individuals whose likenesses are found in the image data to be printed. If any of these individuals are minors, you likewise represent and warrant that you have obtained such written consent, release and/or permission from that individual's parents or guardians (and you agree to provide to us a copy of any such consents, releases and/or permissions upon our request).

You may not use the picturecity.ph photo printing service to print content found in your image data or other material that:

• Belongs to a category prohibited by Article 201 of Act 3815 (the Revised Penal Code), as amended, or by Article 4 of Republic Act 9775 (the Ant-Child Pornography Act of 2009);
• Is otherwise abusive, deceptive, pornographic, obscene, defamatory, slanderous, violent, offensive, constitutes hate speech, or is otherwise inappropriate;
• Consists of copyrighted material used without the express permission of the owner or material that has been altered so that the copyright, trademark, or other proprietary notice is removed;
• Violates or otherwise encroaches on the rights of others including, but not limited to, intellectual property, privacy, publicity, or privacy rights;
• Contains viruses, worms, corrupt files, Trojan horses, or other forms of corruptive code, or any other content which may compromise the platform;
• Advocates illegal activity;
• Violates any law or regulation apart from that mentioned above;
• Harms or advocates harm against anyone, including minors, or;
• Provides a link to material associated with any of the above.
picturecity.ph may, at its sole discretion, refuse to print any content it receives that it deems to belong to any of the above-mentioned categories.

Kindly take notice that picturecity.ph is required by Philippine law to examine image data submitted to it for certain forms of illegal content. It is also required to report the presence of such offending content to law enforcement for investigation.

There is no right to withdraw your order once it is placed as all photo print orders are produced to your specification. However, if goods are faulty, picturecity.ph will either refund the full purchase price (including shipping), or reprint the product at no additional cost. In no other circumstances will picturecity.ph provide a refund.

Please take notice that for photo print orders, differences in color between the printed images and the original image data are not a defect. Likewise, there is no defect if reduced quality is due to the poor quality (for example, low resolution) of the original image data.

Please take notice that the photo print sizes mentioned on picturecity.ph are approximate Some deviations can be expected as the products are created on an individual basis.

You are solely liable for any intellectual property infringement or other violations that arise or result from your use of picturecity.ph and its services. Therefore, you agree to hold Picture City and picturecity.ph free and harmless from any claims or suits brought against it by intellectual property rights holders, or by individuals who did not consent to have their content or their likenesses printed, as applicable, and further agree to compensate and reimburse it for any damages sought by those mentioned above.

You retain ownership of your image data and its content and any rights granted to Picture City and picturecity.ph are granted as a license. Although you retain ownership of your image data and its content, any material, tools, features, templates, or layouts provided to you by picturecity.ph that you use to arrange or organize your material do not belong to you, and the rights to these materials, tools, features, templates or layouts belong to picturecity.ph, or to the organizations from whom these were licensed from.

In order for picturecity.ph to print the content found in the image data you submitted to us, or to otherwise provide its services, you hereby grant to picturecity.ph and its parents, affiliates, subsidiaries, agents, vendors, and assigns the perpetual, irrevocable, worldwide right to copy, display, modify, distribute, transmit, and make derivative works of your content solely for the following purposes: (a) providing its services to you; (b) showing you how your content would appear in a product or service offered by picturecity.ph or one of its agents; and (c) improving its services.

These rules exclusively apply to certain articles described as “Vintage Cameras” and sold on picturecity.ph, including but not limited to the following items:

 

• Kodak EasyShare™ M series digital cameras such as the MD30, M380, M522, M531, M550
• Kodak EasyShare™ C series digital cameras such as the C143, C1013
• Kodak EasyShare™ Mini M200 digital cameras
• Samsung NX cameras such as the NX1000 
• Nikon Coolpix™  series digital cameras such as the S2600, S6200, L27
• General Electric™ (GE) X series cameras such as the X500
• Agfa Selecta™ cameras such as the Selecta 14

 

You acknowledge that while the above-mentioned digital cameras are unused, they are not new. Some deterioration may have occurred during the long period that these goods were stored, and it is beyond the capacity of picturecity.ph to determine its extent. Given these circumstances, you acknowledge that picturecity.ph is selling these articles to you AS IS, WHERE IS with no warranty, that you acknowledge the risks inherent with these particular items, and notwithstanding these issues you agree to purchase the same.

You agree that your only recourse against picturecity.ph in the event you receive your order in a non-working condition, damage caused by the courier or shipping company excepted, is to seek a refund of its purchase price. In such an event, please file your claim via email at [email address] within ten days from receipt of the goods. Kindly describe the facts and circumstances of the case with as much detail as possible, and we will resolve your request in a timely fashion. If approved, refunds will be sent to you in the same manner it was originally tendered to picturecity.ph.

You further agree to waive all other remedies available to you in law or equity in relation to this matter.
